1. Introduction

Welcome to ConstraPak. By accessing our website (www.ConstraPak.com) and using our services, you agree to abide by these Terms and Conditions. These terms apply to all construction, renovation, consultation, and engineering services provided by ConstraPak, led by Engineer Usman Nehal.

If you do not accept these terms, please refrain from using our services.

2. Definitions

• ConstraPak: A construction company registered in Pakistan, specializing in commercial and residential projects.
• Engineer Usman Nehal: Founder and chief engineer of ConstraPak, responsible for overseeing all projects.
• Client: Any individual, business, or entity availing ConstraPak’s services.
• Services: Construction, renovation, consultation, interior design, infrastructure development, project management, landscaping, and maintenance services offered by ConstraPak.
• Agreement: A legally binding contract between ConstraPak and the Client based on the terms outlined herein.

3. Scope of Services

ConstraPak provides a wide range of construction-related services, including:

1. General Construction Services – Building residential, commercial, and industrial structures.
2. Renovation & Remodeling – Upgrading existing buildings with modern designs.
3. Engineering Consultation – Providing expert engineering advice for construction planning.
4. Interior & Exterior Design – Designing and executing creative architectural solutions.
5. Infrastructure Development – Developing large-scale roads, bridges, and utility projects.
6. Project Management – Overseeing entire construction projects from inception to completion.
7. Landscaping & Outdoor Services – Enhancing outdoor spaces with expert landscaping.
8. Building Maintenance & Repairs – Providing long-term property maintenance solutions.

Each service is subject to project feasibility, material availability, and mutual agreement between ConstraPak and the Client.

4. Service Agreement and Project Contracts

• A formal contract must be signed before the commencement of any project.
• The contract will specify project scope, estimated timeline, payment terms, and responsibilities.
• Modifications to the contract require mutual consent and written approval from both parties.

5. Client Responsibilities

• Clients must provide accurate project details, site access, and necessary approvals before work begins.
• Any delays due to permits, licenses, or client-side changes may result in timeline extensions.
• Clients must ensure timely payments as per the agreed schedule to avoid project suspension.

6. Payment Terms and Conditions

• Advance Payment: A minimum of 30% of the total project cost must be paid before project initiation.
• Installments: Payments are made as per the milestones mentioned in the contract.
• Late Payments: Any payment delays beyond 7 days may lead to work suspension and penalty charges.
• Refunds: Payments made are non-refundable, except in cases where work has not started or ConstraPak fails to fulfill its obligations.

7. Project Timelines and Delays

• Estimated project completion dates are subject to material availability, weather conditions, and external factors.
• ConstraPak is not liable for delays caused by government approvals, third-party vendors, or force majeure events.
• Clients will be informed of any major delays with revised timelines.

8. Quality Assurance & Material Usage

• ConstraPak ensures high-quality construction materials are used, following industry standards.
• Any material substitutions or upgrades requested by the Client will be charged separately.
• Clients are welcome to inspect materials before installation.

9. Liability Disclaimer

• ConstraPak and Engineer Usman Nehal are not responsible for damages arising due to:
  • Changes requested by the client mid-project.
  • Third-party contractor interference.
  • Natural disasters or unforeseen site conditions.
• Clients must carry property insurance for added protection.

10. Warranty & Post-Construction Support

• A 1-year warranty is provided on all structural work.
• Warranty does not cover natural wear and tear, misuse, or modifications made by other parties.
• Clients may request additional maintenance packages for ongoing support.

11. Intellectual Property Rights

• All architectural designs, blueprints, and creative solutions developed by ConstraPak remain its intellectual property.
• Unauthorized reproduction, resale, or use of ConstraPak’s designs without consent is prohibited.

12. Termination of Services

ConstraPak reserves the right to terminate any project if:

• The client fails to meet payment obligations.
• The project is deemed unsafe or legally non-compliant.
• Mutual agreement to discontinue the contract is reached.

In such cases, any outstanding dues must be cleared before project closure.

13. Governing Law & Legal Disputes

• All agreements are governed by the laws of Pakistan.
• In case of legal disputes, parties agree to resolve matters through arbitration before seeking legal action.

14. Privacy Policy & Data Protection

• ConstraPak ensures the confidentiality of client data and project details.
• Personal and project-related information will not be shared with third parties unless required by law.

15. Amendments to Terms and Conditions

• ConstraPak reserves the right to update these Terms and Conditions at any time.
• Continued use of services after amendments implies acceptance of the revised terms.
